We would give you a disapproving look for letting your friend drive, and we would take both you and your friend’s insurance information. Most likely, if your friend is the one who was said to be driving; it would go under his insurance, even if he was not listed on the rental contract. Because you were the primary driver, you technically CAN give permission for someone else to drive it that isn’t listed, even though that’s not generally a good idea. I have filed claims like this before at my rental office and even if there was an unauthorized driver who caused the accident, most likely it would go thru that unauthorized driver’s insurance. There was one instance that an unauthorized driver totaled one of my cars (he didn’t have insurance), and the primary renter’s insurance had to legally pay for all damages because their insured had entrusted the other driver w/ the keys. It’s complicated, but honestly, I wouldn’t lose sleep over it.
